Collecting your service charge

Ringley Legal Services Article

Effective property management is wholly dependent on effective credit control. Contractors paid on time are happy contractors, who will be pleased to attend to your next emergency . Every client that signs a lease or transfer document has already promised to pay their service charges when due. (Normally within 21 days of the due date.)

This is why at Ringley we operate strict credit control to enforce the highest possible standards of all rent and service charge collection.

These flow charts document the process from start to finish:

What is a service charge? Find out here.

Credit control measures may include:
  1. applying interest to arrears as stated in the lease
    (stage 3 on flowchart)

  2. sending polite and final payment requests
    (stage 3 on flowchart)

  3. carrying out a Land Registry search to verify ownership prior to stages (4) or (5)
    (stage 5 on flowchart)

  4. applying to the County Court for a money judgement, the court fee being initially borne by the Client but will be charged to the defaulting Tenant’s account
    (panel A on flowchart)

  5. in the unlikely event that a case cannot be determined by allocation questionnaires and specific court attendance is necessary Ringley will either (a) represent the Client at Court (in the presence of the Client) or (b) instruct legal representation using the direct access to representation route
    (panel G on flowchart)

  6. applying to the County Court for an attachment to earnings order
(stage S on post judgment flowchart)

  7. applying to the County Court for permission to enter the judgement on the charges register against the property
(panel O on Post Judgment flowchart)

  8. lodging a charge against the property title to prevent it being possible to sell the property without discharging the debt
(panel P on Post Judgment flowchart)

  9. writing to the defaulting Tenant’s place of employment to seek enforcement of an attachment to earnings order
(panel T on Post Judgment flowchart)

My 30+ years of practical property and senior managerial experience has involved me in all types of properties from major historical London Estates to complex modern mixed use schemes both within prime central London and beyond. Over the years I have probably encountered most block management issues and both personally and through my teams have strategically managed solutions. The momentum of continuous improvement both here at Ringley and that is building within our sector makes it an exciting time to be in Property Management.
